Lincoln County was formed in 1779 from Tyron County and later parts of Burke County were added. Most of the cases are about debt whether it is called “case”, “trover”, “covenant” or “debt”. There are a few ejectments and cases of assault & battery. A trial is sometimes mentioned even though the case is in the appearance docket. There are numerous cases that are continued from one session to the next and finally settled by “non pros” [not prosecuted] or “dismissed”. So the details of the case can be difficult to determine. Some appeals from magistrate court are mentioned at the end of the trial docket without previously being on appearance docket. It is hoped this book will give genealogists an idea of the type of material present and absent from trial and appearance dockets in North Carolina counties.
